Sutter County supervisors are set to consider a new $10 recording fee to help pay for a mandatory recorder notification program required under SB 255.

A staff report on the Sept. 8 agenda says the board is being asked to set a public hearing on a resolution that would establish, effective Feb. 1, 2027, an additional $10 recording fee for the program. The hearing is requested for Sept. 29 at 3 p.m.1

The report says Senate Bill 255, enacted as Chapter 351, Statutes of 2025, added Government Code section 27297.7 and requires counties to establish a Recorder Notification Program by Jan. 1, 2027.1 Under the law, county recorders must mail notices after recording certain documents, and counties may also set up electronic notification systems.1

The county report says the board may authorize a fee to recover reasonable program costs, subject to a 120-day public notice period before implementation.1 It also says several California counties already charge $10 for similar notification programs and that the recorder’s department is requesting the same amount.1

The agenda item does not yet show a final board decision on the fee itself. It only asks supervisors to set the hearing process in motion.1
